I don't have any real-world examples handy, but here are a couple of
theoretical examples that ought to illustrate what I'm talking about.

Let us suppose for just a moment that the Forgotten Realms magic book had
been released under the OGL (it hasn't and will not be). Let us assume for
the sake of argument that everything related to The Forgotten Realms was
designated as PI, and that such designation is clear and unambiguous.

Now if you look at the rules for Spellfire (Spellfire mechanics, Spellfire
feat, Spellfire Wielder prestige class). Those rules use PI in their
description but the rules themselves, to such an extent as they do not
embody the PI, are OGC. That means that the terms Spellfire, The Weave, and
the Shadow Weave are PI but the mechanics for granting a character the
ability to convert spell slots into blasts of fire are OGC.

Same thing for the SW rulebook. If it were released by Wizards under the OGL
(it hasn't and will not be). Let us assume for the sake of argument that
everything related to Lucas Arts was designated as PI, and that such
designation is clear and unambiguous.

Now if you look at the rules for The Force (Force feats, Force powers, etc).
Those rules use PI in their description but the rules themselves, to such an
extent as they do not embody the PI, are OGC. That means that the terms 'The
Force' and 'Jedi', 'Dark Side', 'Sith' and 'Force Lightning' are PI, but
'Sense', 'Control', and the actual rules for Force Lightning (damage,
Vitality cost, accumulation of evil) would not be.

I believe that is an accurate statement.

I hear that the new d20 Traveller book will have exactly that situation. The
rules that come from the SRD (character classes, feats, combat, etc) will be
OGC (to the extent that they do not embody the Traveller universe, which
will be PI). The rules adapted from classic Traveller (starship
construction, system generation) will be released outside of the OGL (as
'closed' content). As soon as my copy arrives I'll confirm this supposition,
but that is what I understand from Hunter and others on the T20 discussion
list.
