Really, there isn't a whole lot you can do about it. They're completely
unavailable.

On the otherhand, that isn't to say there aren't substitutes. 

Prestige Classes: I point you to the prestige classes put out for the
Scarred Lands Campaign Setting. THOSE are prestige classes. They fill a
specific role in a specific universe. The prestige classes in Tome and Blood
are a selection of powers waiting to be customized to fit into a world.

Levels higher than 20th: Everquest managed to do it just fine without once
mentioning the Epic Level Handbook.

Hey, I'm new to the list.  How ya all doing?

I have a general question.  Probably common knowledge but I couldn't
find it in the archives.  Since the splatbooks and Epic Levels aren't
open content, can they be used in any form?  For instance, can I give a
character in a d20 product a prestige class from Tome of Blood is I
don't do anything but list the name and level and refer you to the book?
Also, what can I do with writing up higher than twentieth level
characters?
