His "How I would decide" points are wholly a one-sided opinion from the standpoint of an advocate for unencumbered, limited copyright. If Disney's lawyer (or Microsoft's for that matter) wrote the "How I would decide" section, you'd get a 180 degree opposite view. Probably more hurtful than helpful.
