I could have made it.
Although I rarely use OGC material other than the SRD or a given publishers own stuff in my freelance writing, because most publishers seem to want all-new material or OGC that's already theirs, I will happily say the -main- reason I bought the Tome of Horrors was its clear, concise and friendly OGC designation.
I don't know how you could have made it clearer, either.
On a side note, I'm really glad I did buy it as it turns out to be among the best d20 monster books.
