I have no problems with a company making a mistake. It happens. But Mongoose has made countless mistakes, and has failed to demonstate any good faith by actually addressing the problem once it arises.
By contrast: AEG forgot to update their Section 15 for WAR. I contacted them regarding the oversight (because I wanted to use some material from WAR and didn't want to leave them uncredited through a literal interpretation of the license) and within a couple of days they had gotten back to me with the required fix. *That's* the correct approach. That's the approach that won't leave a bunch of pissed off people in your wake and lawyers on your trail.
IMO, the Netbook folks should go after Mongoose on this one. I don't think they should push for a full recall (unless they want to -- it's their legal right to do so), but I do think that they should be looking at reasonable ways of hitting Mongoose in their pocketbooks through a settlement that comes short of recall.
Why? Because Mongoose has demonstrated repeatedly that They Just Don't Get It(TM). And apparently the only way they're *going* to get it is if somebody figuratively slaps them across the face.
