If you add code in new files, it is fully optional to the author whether the
new files are put under CDDL.
Yeah, but I focus more on changes then on new files. It is also more sane to also add new files as CDDL. But patches, changes are supposed to stay open and must be open to follow license. Adding new files licensed differently and not open is not accepted in mainline open source projects, anyway.
