An OS is legally not "Unix" (a registered trademark) unless it has passed a conformance test suite. OpenIndiana has not passed this test suite, but earlier versions of Sun's Solaris did.
There are "Unix" systems (e.g. Apple's OS X) which do not include any AT&T source code.
