Hi Kenny,

 

This is to let you that I am contesting your decision to extend rule 3c to 
apply to the subcommittee election, which you used to basically invalidate the 
ArchCom subcommittee election.

By extension this provision also then applies to the members of any TSC 
subcommittee.]

 

Your decision is going to set a precedent moving forward and I believe the TSC 
should officially make that decision, and the bylaws should be updated 
accordingly, to specifically state the guidelines without running any risk of 
any miss-interpretation in the future.

 

I am also requesting that your “new call for nomination” be suspended until the 
TCS has had the opportunity to review the election outcome and render a decision

 

Your rationale for dismissing the election results was based on the following 
statement:

[There are 15 designated voting members of the Architecture Subcommittee. 
Between uncast ballots and abstentions there were not enough votes cast in 
favor of the candidate to confirm the election.]

 

Based on the above statement I have a few observations:

1.      You said in your statement “there were not enough votes cast in favor 
of the candidate to confirm the election”

a.      How did you define “enough” and where is that defined in the bylaws?
b.      What would have been an acceptable voting result in this case?
c.      Have you looked at previous elections to see if we had a similar 
situation? How were they handled?
d.      Did you interpret “abstain” as “neutral/Don’t Care” or as a vote 
“against” the candidate

2.      your statement also failed to mention that this was a non-contested 
election, which could have impacted the election participation (Should 
non-contested election be governed under different rules??)
3.      Election results:

a.      15 people were eligible to vote, only 8 decided to cast their votes - 
b.      5 votes were cast for me
c.      3 abstained

 

I am also requesting that we put this topic on the agenda for the next TCS 
call, Dec 12, 2019, so the TSC can review and decide on the outcome.

Ballots have been distributed to voting delegates.
