Well put. As an attorney, and a defender of the Constitution, especially against the incursions of this Administration i share your concerns of this, i think, ill conceived plan.
Another reason it hasn't been discussed much lately, however, i think is the fact the Bush Administration has backed-down somewhat from the idea when they realized that not all faith-based organizations are Christian-based organizations and they would also have to support other faiths or face even more legal challenges.
