Well, i'd say that writing a driver for a GPL'ed device
would be like using a common protocol to talk with a
GPL'ed program. (Otherwise non-GPL software would not
be allowed to "talk" to GPL software)

There is. Think about someone using the PCI core on one chip
and using a closed design on an other.
