So, it's not great, but we can do it.  In the GPL'd version, what
you'll get is an empty stub module in place of whatever logic we would
otherwise include in order to implement HDCP.

IIUC from SiliconImages's web site, the complete implementation of HDCP is in their transmitter chip. There is an I2C connection to the chip which I presume can turn HDCP on and off.

I don't see right off how this could work with your suggestion unless they (or another company) sell pin compatible chips both with and without HDCP.
