Do it. My preference is release it under AGPLv3.

Have you had a discussion with the SUNY licensing folks? What I read at

sounds like a very good deal. If you decide to pull the trigger and fill
out a rfsuny.org technology disclosure form, (which I think you should),
please let the commercialization folks know I would like to discuss 
open-hardware patent cross licensing with them, as well as how to work
with senior design teams at Iowa State and University of Minnesota on
the OpenShader project.

The biggest argument **FOR** giving the SUNY system a 60% cut is this:

We will now have a very big stick to go after the inevitable violations
when some chip maker rips off the HDL code and tries to avoid paying
for a commercial license.
