Agreed. Looks like it should be possible to tackle at the transform level per http://www.methods.co.nz/asciidoc/faq.html#_how_can_i_include_chapter_and_section_tables_of_contents and http://www.sagehill.net/docbookxsl/TOCcontrol.html (writers shouldn't have to do anything different).
