Per my reading, this only covers the founding committee members use of AFS in the "OpenAFS Foundation" name (which apparently at the time of signing had not been incorporated yet):

IBM hereby grants [..] right and license [..] to use the Marks as part of The 
OpenAFS Foundation name.
[..]
Members may not sublicense or assign any of the rights [..] except [..] to the 
newly incorporated OpenAFS Foundation, once that entity is formed.

In other words, this seems not to be the agreement that allows OpenAFS to be called OpenAFS.
