>But we'd have to be using the name for a year before registering, correct?
I don't think so, Anthony.
The registration process takes six-nine months. One can file an
application if one is using the tradmark in commerce or has a reasonable
intention of using the trademark in commerce within six months.
If one files on the basis of intended use, there is an additional $100
filing fee when the trademark is actually used and registered. If the
trademark is not in use after six months, one can get one or more six month
extensions at $100 each.
