I did the same thing Jacek did for openejb.xml file, I omitted the license from the example DDs, after I did that the test cases was still failing cause of encoding issues and I spent a suitable time to find a suitable editor to save the XMLs in the appropriate encoding, here is the new patch to review https://issues.apache.org/jira/browse/OPENEJB-322 and plz take a look at this mail if u r not already looked at it http://marc.theaimsgroup.com/?l=openejb-development&m=116380865311923&w=2
