There are two alternatives to upgrading to OpenLayers 2.11-rc1,
although I would strongly recommend the upgrade.

1) Apply 
http://trac.osgeo.org/openlayers/attachment/ticket/2984/openlayers-2984.patch.
No other changes required.

2) Apply 
http://trac.osgeo.org/openlayers/attachment/ticket/3312/openlayers-3312.4.patch
and change your Google layers to become OpenLayers.Layer.GoogleNG
instances. This layer type uses the Attribution control to display
copyright information, and lets OpenLayers manage the tiles rather
than providing a whole Google map.
