Yes, it's definitely a combination of the device and OS. On many droids such as my HTC Incredible running 2.1 and 2.2, the pinch is used by the OS to magnify the screen. It's not a browser window resize nor a mouse event passed into the browser; it's much like using the screen magnifier on other OSs.
That's nice to know though, that some droids do support pinch. Hopefully future ones will too, as I like the pinch effect a lot.
