This hack definitely violates the Terms of Use. The reason for the reappearing popup is tht th 3.6 version of the GMaps API is no longer available, so you get 3.7 now even if you request 3.6.
Until somebody provides a fix in OpenLayers, my advice is to use a different base map. Andreas.
