The file with the restriction isn't an OM file. The header says:
Copyright (c) 2004-2007 Atheros Communications Inc.
I've attached a patch in bugzilla.

It sounds more like a bug for the madwifi programmers.
ath5k is still in a early stage of programming. (so far i know)
And they don't have ported every feature from the madwifi driver yet.
