Nvm I think I figured it out, it is just the debug base address was wrong. I 
had two boards which I thought was the exact same, but turns out they are not.
So when I went from one board to the other it starts to fail.

Hello James :-) Quick greping the sources showed where to look for answers:

target/etm.c: * most common ARM9 systems.  Note: "CoreSight ETM9"
implements ETMv3.2,

Sorry I am not familiar with this component yet so thats all I can help for now 
;-P Also it seems that MEM-AP has some error flags checking in JTAG part of the 
code. What device are you working with?
