You can get GPL compatible tftp code from eCos. tftp kinda sucks though:
You have to find some tftp server that allows setting up a non-default package size negotitation. 512 bytes is the default package size and the gdb load protocol beats the crap out of this out of the box with it's neat autonegotiation capabilities(thanks to Spen mostly!) It's nice not to have to install more servers than just OpenOCD.
