Makes Sense -

I think I will add this as a feature request to the tracker as this issue
will most likely present itself in the furture when it comes to interopping
with larger carriers.

Starting a session with T38 only seems perfectly legal.
It seems that your GW is not accepting that so it's not openpbx fault.
