A very good news:

At Spanish DNIe Site [1] guys from TechOffice [2] have published the Developers
reference guide for the DNIe. Contains Documentation !And SM keys! enought to
create an independent development of DNIe pkcs#11 module

Documentation is distributed by mean a sort of Apple/Android Individual
Developer license. No License (yet) for Groups nor Companies. But terms of
license allows -almost free- redistribution of documentation and code. [3]

Actual DNIe [4] published code is under GPL Terms and cannot be used freely in
OpenSC. Moreover: recent changes on OpenSC-0.12 libopensc makes it near
unusability.

The document is already in the web [5] accessible to anyone without signing DGP
contract

So IMO is time to get the Document and start working in an independent
development of DNIe OpenSC module. We have de docs, we have the code, we have
the SM keys, we are longing to write code.

Need a previous legal study about using published docs in a distributed group
-non personal- development, but there is allways the chance to "extract"
conflictive info from other sources

A real good news
