I see no problem.

The Law forbids to give away the Copyright and 
the Sun text contains a salvatoric clause:
"to the extent allowable under locallaws".

Sun would need to know, that Sun is most likely not 
allowed to register a Copyright for the code 
because there is an aggreement between the USA and the EU
for crosswise acknowledging the local Copyright laws.
