Free, as I understand it, but not yet open-source. I'm no lawyer, but I read the new license agreement pretty carefully yesterday and it lists commercial use, personal use, even ratio-based service-provider use. And it's not just Sun Cluster.... it's all the N1 stuff, JES, Identity Management, etc! Sun Cluster seems to be called "Java Availability Suite" now.

Some conversation (by Sun folks) on the Info-iMS mailing list has recently taken place regarding the eventual possibility of open-sourcing the JES stack. They said the lawyers were looking into it. Don't know if that means Sun Cluster might eventually be open-source of not.
