There has been a lot of negative reaction to the news that Google is evaluating/test driving OpenSolaris. So I think this news has much to do with that and the fact that the FSF is scared they might loose Google. This isnt the first time they have used scary terms to intimidate people. Proprietary software and drivers are "illegal" by the way.
