Some items are still closed because (at least as I understand from
other discussions) Sun doesn't own the rights to release the source
for them; others simply haven't been opened yet.

However, they're a tiny fraction of what makes up OpenSolaris.

And the binaries for which source hasn't been released that are needed
to make a working distribution out of OpenSolaris are available binary only,
under the license

http://dlc.sun.com/osol/on/downloads/current/
(the "Binary-Only Components" for SPARC and x86)

There may be others on the download pages for other consolidations as well.

As that first reference shows, some are planned to be opened up
(presumably as resources to do it with proper observance of all the
legal niceties and anything else needed to do it right become available),
and some are not planned to be opened up at all (presumably because
there are significant obstacles, rights lacking, etc; prior discussion has
suggested that there may be reasons they can't even tell you _why_
they can't open particular items, even though they might want to).

This may also be true in other consolidations (like DevPro), not just in
O/N.

Progress has already occurred; that is, some items that weren't open
earlier are now; for example, I think libm (math library) was a sticking
point for some folks early on.

At least some of the items that will probably never be opened are being looked
at by some folks outside to see if they could write a replacement (for example,
the i18n code).  OTOH, others are so seriously tricky that an independent
reimplementation may be unfeasible, although in some cases they may not be
strictly necessary, either (the NFSv2/NFSv3 locking support may fall in that
category; I think the NFSv4 locking support is open though).

Disclaimer: all the above is simply my recollection of what I've read, mostly on
the discussion forums here; I may have forgotten something interesting, or 
gotten
some of it wrong.  I have no inside knowledge, and by just reading enough of 
what's
happened in the discussion forums, you could probably find even more info than 
I've
summarized, better form your own opinions, etc.
