No, that's controlled by The Open Group, although the members (of which Sun is only one) that contributed may have something to say about it too.

Note: Sun's CDE is AFAIK _not_ CDE 2.1, although it has many but not all of the features, as well as a lot of Sun-specific add-ons and improvements (or at any rate changes). FYI, there is a petition at http://www.petitiononline.com/opencde/petition.html requesting The Open Group consider open-sourcing CDE.
