You are missing the point. The original question was about an appliance with Solaris on it. Someone else pointed out that to redistribute any official versions of Solaris from Sun (such as Solaris, Solaris Express, etc.) you must have a redistribution agreement with Sun. If you want to "roll your own" using the OpenSolaris codebase on opensolaris.org or use Belenix, etc. you can do so as long as you follow the license agreements.
