I searched and search and found nowhere where Jonathan or anyone said  
that they would "promise" that OpenSolaris would be released under  
GPLv.anything. All I see in the URLs you reference is hearsay from  
sloppy tech journalists.

So if no promise was made, how would it be broken? It may be that  
you're reading a poorly-written source of information, or that you're  
misunderstanding "looking into" or "considering" as meaning "promising  
to actually do it"
