You would think. Not if the patches are new. Here is a list of
patches for Studio 12 with the age of the patch in days.

so if a patch is newer than the tarball then .. you don't get that patch.
Next issue is that you really need Studio 11 to do much of anything
with OpenSolaris or Solaris Nevada anyways because that is what the ON
pages says. The latest Studio 11 tarball that is linked onto the
OpenSolaris site says :
Sun Studio 11 Software for OpenSolaris sunstudio11-ii-20070828-sol-x86.tar.bz2
So that would be August 2007 ? A year ago.

The Sun Studio Compilers (Recommended). NOTE: Sun Studio 11 is
required for building Build 45 and higher. Builds prior to Build 45
use Sun Studio 10. Please note that the compiler that comes with the
Solaris Developer Express release is Studio 12, and there may be some
problems using it to build ON. If you use Studio 12, please do report
problems, particularly if the problem goes away when you use Studio
11.
