One thing is the partition type (which is 0x82 for both old Solaris and Linux 
swap), ant another thing is the filesystem on this partition, which is UFS2 for 
Solaris and swap for Linux swap. Additionally, Linux does not uses the 0x82 
labeled partition for swap if it doesn't appear in the /etc/fstab as an entry:

/dev/hda5    swap    swap    defaults    0    0

or something like this.
