While the new regulations do allow the export of source code from the
U.S. without prior review and without a license it is not clear that
OpenSSL.org is going to want to incorporate that code into OpenSSL.
That is because while U.S. originating code may be exported, products
that incorporate become covered by the E.A.R. and must adhere to the
U.S. governments decisions on which countries are to be considered
terrorist states. This list includes the well known seven and now
Serbia and Taliban held Afghanistan.
The new rules do remove the restriction on technical assistance
(except to terrorist states) so it would appear that documentation
might now be something that U.S. developers could submit.
These are my opinions after reading the new regs and carry no legal
weight whatsoever.
