Neither 0.9.9 nor 0.9.8 contain any FIPS code. The actual FIPS code is the "OpenSSL FIPS cryptographic module v1.0" this corresponds to the sources under the fips-1.0 directory in the OpenSSL 0.9.7 stable branch of OpenSSL.
