If you've never seen trademark law upheld in court you can't have looked very 
hard. As a quick example, have a look on the internet for "Microsoft corp. v. 
Lindows". It's a nice and fairly topical case of trademark infringement. 
Somewhat controversial perhaps, but still a display of a court upholding 
trademark law. Not the first one, and it won't be the last.

trademarks are registered, unlike copyright. You can call it what you like, 
but if it's been registered as a trademark it won't matter, it will still be 
protected by trademark law.
