Many kernel developers say: Yes.
Few say: No.
Quite some say: Don't care.

This hasn't been brought up to court, thus any claim that it is a direct
violation is just that: a claim.
We make business with distributing the Linux kernel, we cannot risk
being sued. Nvidia can.
