Interestingly SCO does not 'own' Unix. The Unix brand is owned by The
Open Group. SCO has the right to license, enhance, and distribute. They
do own copyrights on their changes to Unix.

They certainly can, but is it worth their while. 

Also remember that there are some issues in the SCO vs. IBM case other
than copyright infringement (which Novell waived) that affect Linux.
