I did go through the file and found the problem in
/lib/mkinitrd/scripts/setup-splashy.sh  I dont know if it is a bug, but
if it did not find /usr/sbin/resume it would exit.  It would not remove
the first temp directory, thus the error for the existing directory.  I
was able to resolve the issue by installing suspend.
