I am under the impression that DFS with ath9k is working in trunk (3.10.x).

                          DFS state: usable (for 2779417 sec)
                        * 5700 MHz [140] (15.0 dBm) (radar detection)
                          DFS state: usable (for 2779417 sec)
or (switched region):
                        * 5680 MHz [136] (15.0 dBm) (radar detection)
                          DFS state: usable (for 466 sec)
                        * 5700 MHz [140] (15.0 dBm) (radar detection)
                          DFS state: usable (for 466 sec)
                        * 5745 MHz [149] (disabled)

wireless drivers are:
