I think there are different types of elliptic curves encryption
techniques, curve25519 wikipedia page mentions it is patent-free:

In any case, it is a US-based lawsuit where defendants should be able
to raise Alice as a defense.

Note that the EPO "jurisprudence" finds crypto as patentable.
