I think there are different types of elliptic curves encryption techniques, curve25519 wikipedia page mentions it is patent-free: https://en.wikipedia.org/wiki/Curve25519 http://cr.yp.to/ecdh/patents.html In any case, it is a US-based lawsuit where defendants should be able to raise Alice as a defense.
