From the eBay website, it's pretty clear that it is not OK to steal pictures.

Unfortunately, those who post photos on the internet know that borrowing
(i.e. theft) of these photos is commonplace. The worst example is people
selling on eBay. Even when you tell them, many continue using the photo.
When you tell eBay, eBay responds they saying that they are not responsible.
However, under Canadian law - and I believe American law is identical on
this point - once eBay is notified, they have an obligation to remove the
offending material immediately. Moreover, people guilty of this practice
such as Linda Parks and William vanVliet should be blacklisted permanently.
I have seen photos from my web site used as well as photos from the web site
of Greg Allikas.
I am waiting for the American lawyer to take a class action against eBay for
this because, until that happens, eBay will continue to encourage this
practice and everyone posting photos is at risk.
