I do remember reading that if you (as a screenweaver user) pack the Flash ocx, you need approval from MM to distribute it.
I can't find it on that page though and can't remember where I read that. Maybe it was on the old Screenweaver website.

The default option is to not pack the ocx, which means the end-user needs to have Flash installed, or will be prompted to do so if
no plugin is present.
