ahh, stupid opera and their document.all implementation... it works for me now in 8.5 (i don't have 8 installed, but i think it will be ok - let me know if it's still broken)
as for the flash detection in ie - it sounds like you probably just have a bad install. try running the flash player uninstaller and reinstalling it clean.
