4 militants charged with terrorism

Abuja - FOUR men were yesterday slammed with a five-count charge of
terrorism in the Niger Delta. Charged were Livingstone Kiani, Eric Abadida,
Uroh Kiani and Loveday Lucky.

They are facing a five-count charge of terrorising and disturbing the
operations of Conoil and Gas Limited in Brass Local Government Area of
Bayelsa State between July 4 and 8. They were accused of kidnapping one of
its employees, retired Lt. Commander Julius Oni with a view to extorting
from the company a sum of N10 million in the name of ransom.
Their conduct, according to the charge, offends section 15 (1) of the EFCC
(Establishment) Act 2004; Section 364 (2) of the Criminal Code Act (CC), Cap
77, Laws of the Federation 1990 with section 3 (1) (a), (b) of the Criminal
Justice (Miscellaneous Provisions) Act, 1975, No 30 of 1975 and punishable
under section 15 (2) of the EFCC Act and section 3 (2) (a) (b) of Criminal
Justice Act 1975.
All of them, however, pleaded not guilty to each of the charges.
They said they were neither terrorists nor hostage-takers even as they
challenged the Federal Government to prove its case against them, if it had
any.
Besides, they said ordinarily, they ought not to enter any plea without
seeing the charges preferred against them but that given what was read in
the open court, there was nothing for them to fear and  were set for the
trial to commence.
However, the Federal Government described them as a bunch of liars, saying
there were more than enough material evidence to nail them.
According to the Federal Director of Public Prosecution, Mr Salihu Aliyu,
men of the State Security Service (SSS) ought to be commended for a job well
done in nabbing all the accused persons.
He said they had all confessed to the crime after they were confronted with
unassailable evidence. He urged Nigerians to patiently wait till the next
adjourned date when government would open its case against them.
The court has, however, adjourned hearing in the case till November 2, this
year while an order remanding them in the SSS custody was issued yesterday
by the vacation judge, Justice Anwuri Chikere.
Meanwhile, counsel representing the accused persons, Mr Emmanuel Chukwumah,
yesterday said he would bring an application for their bail soon. He
complained to the judge that he was not given a copy of the charge before it
was read out to his clients, adding that all the accused persons were not
made to know what they were being charged with.
The judge sympathised with him on this score. He said: "You knew your
clients had no knowledge of the charges brought against them and you were
there looking until all were read and their pleas taken. You ought to have
spoken out. The charges ought not to be read to them until they see it. It
is your fault. All I can do now is to ensure that they are all served now
and I so direct."
The arraignment yesterday is a confirmation of the Federal Government's
resolve to clamp down on terrorism and hostage takings in the Niger Delta.
President Olusegun  Obasanjo gave an indication of this initiative at a
meeting with stakeholders in the Niger Delta, Tuesday, where he said
government had had enough of hostage takings in the region.
