Syrian-born German terror suspect Zammar standing trial in Damascus

BERLIN A Syrian-born German man who is suspected of recruiting Sept. 11
suicide hijacker Mohamed Atta for al-Qaida is standing trial in Damascus,
Germany's Foreign Ministry said Wednesday, while another source indicated he
faces the death penalty.

Mohammed Haydar Zammar, 45, is being tried before the Syrian State Security
Court in Damascus, a German Foreign Ministry spokesman said, speaking on
customary condition of anonymity.

The spokesman declined to comment on the charges Zammar faced, saying only
"the ministry is trying to care for Mr. Zammar, and regarding the trial, is
trying to get legal assistance for him."

Earlier Wednesday, German ARD public television's main news program,
tagesschau, reported Zammar's trial opened on Oct. 8, on charges of
terrorism and that the he could face the death penalty.

A source familiar with the trial, who declined to be identified because he
was not authorized to speak to the press, said Zammar faced charges of
membership in the outlawed Muslim Brotherhood group. Membership in the
Muslim Brotherhood, can be punished by execution under Syrian law.

Zammar was questioned by German authorities following the Sept. 11, 2001,
attacks, but was freed for lack of evidence. He then traveled in October
2001 to Morocco and was captured in December.

The exact circumstances of his arrest are unclear, but according to U.S.
officials, Zammar - a naturalized German born in Syria - was taken into
Syrian custody.

Germany's top security official, Interior Minister Wolfgang Schaeuble has
said that U.S. officials delivered Zammar to Syria.

Zammar is widely believed to have to have introduced Atta and the two other
Hamburg-based Sept. 11 pilots - Ziad Jarrah and Marwan al-Shehhi - to
leaders of Osama bin Laden's organization in Afghanistan, where they all
received training.

German officials were able to question Zammar in Damascus in November 2002,
which triggered widespread criticism in Germany, because of fears he had
been tortured while in custody in Syria.

Syria has refused to recognize Zammar's German citizenship and insists on
treating him as one of its own citizens, despite repeated attempts by the
German embassy to assist him.

"Fair Use" criteria established in Section 107 of the Copyright Act of 1976.
The principle of "Fair Use" was established as law by Section 107 of The
Copyright Act of 1976. "Fair Use" legally eliminates the need to obtain
permission or pay royalties for the use of previously copyrighted materials
if the purposes of display include "criticism, comment, news reporting,
teaching, scholarship, and research." Section 107 establishes four criteria
for determining whether the use of a work in any particular case qualifies
as a "fair use". A work used does not necessarily have to satisfy all four
criteria to qualify as an instance of "fair use". Rather, "fair use" is
determined by the overall extent to which the cited work does or does not
substantially satisfy the criteria in their totality. If you wish to use
copyrighted material for purposes of your own that go beyond 'fair use,' you
