New York judge: Terror defendants' pre-trial prison solitary OK 12/7/2006, 4:34 p.m. ET By LARRY NEUMEISTER The Associated Press NEW YORK (AP) --- A judge on Thursday refused to order a terrorism suspect --- a jazz musician who also is a martial arts expert --- moved out of solitary confinement after prosecutors claimed he was so dangerous he suggested using prayer beads as a strangulation tool. U.S. District Judge Loretta A. Preska denied the request by lawyers for Tarik Shah and his co-defendants that they be moved from special housing in the Metropolitan Correctional Center in lower Manhattan that leaves them isolated while they await trial. She said the government had offered tape recordings to support that Shah was an accomplished martial arts practitioner who had tried to recruit others to join al-Qaida and that he had offered to train them. She said some evidence indicated that "his prayer beads have been or in the past were fashioned as a strangulation device" and noted that the Bureau of Prisons had a duty to protect other inmates. The judge ruled from the bench after listening to oral arguments on a subject that had been debated in court papers for months. Shah, of New York, Dr. Rafiq Abdus Sabir, of Boca Raton, Fla., Abdulrahman Farhane, a Brooklyn bookstore owner, and Mahmud Faruq Brent, of Gwynn Oak, Md., are awaiting trial on charges that they conspired to help a terrorist organization. They each could face up to 30 years in prison if convicted. They have pleaded not guilty. A lawyer for Shah, Renita K. Thukral, asked the judge to order the Bureau of Prisons to permit her client to be released from solitary confinement or to give sufficient reasons why the confinement was necessary. In court papers, the government said trial evidence will prove Shah is a martial arts expert and trainer who has studied extensively in jujitsu, which he has described in a government-recorded conversation as the Japanese art of hand-to-hand combat and knife and stick fighting. Assistant U.S. Attorney Jennifer Rodgers wrote that Shah had offered to help train al-Qaida operatives for hand-to-hand combat and in the use of weapons, including swords and machetes, and had shown an undercover agent how he had fixed his prayer beads to be used as a weapon. +++ -------------------------- Want to discuss this topic?
