AN accused terrorist was attracted to the alleged leader of a home-grown
terror cell because he taught it was permissible to steal and commit fraud
under Islam rather than out of any interest in violent jihad, his lawyer
said today.

Benjamin Lindner, the lawyer for Bassam Raad, 26, told the jury in
Australia's largest terrorist trial that his client liked the idea of
committing fraud in the name of Allah and being able to "make a dollar".

He was encouraged to do this after self-proclaimed Islamic sheik Abdul Nacer
Benbrika gave him a religious ruling - or fatwa - that it was permissible to
steal from non-Muslims.

Mr Raad became involved in credit card fraud with another of Mr Benbrika's
followers and discussed carrying out bank frauds.

"That was always behind Bassam Raad's attraction to Mr Benbrika," Mr Lindner
told the Victorian Supreme Court.

"He found that a pretty attractive proposition.

"Bassam Raad wasn't a terrorist, although he was a naughty boy."

Mr Raad not only lacked the "slightest interest" in violent jihad, his use
of marijuana was at odds with extremist Islamic beliefs, Mr Lindner said.

"A bong is not the best weapon in the pursuit of violent jihad," he said.

Mr Lindner said Mr Raad, who was keen to learn about Islam, followed not
just the teachings of Mr Benbrika, but also the teachings of a more moderate
Melbourne Muslim leader in 2004 and 2005.

He told the jury there was little actual evidence presented by the
prosecution involving Mr Raad, saying the Crown had attempted to bury his
client in an "avalanche" of irrelevant material.

Mr Raad, Mr Benbrika and 10 other Melbourne Muslim men have pleaded not
guilty to a range of terrorism charges, including belonging to a terrorism
organisation.

The hearing before Justice Bernard Bongiorno continues.

"Fair Use" criteria established in Section 107 of the Copyright Act of 1976.
The principle of "Fair Use" was established as law by Section 107 of The
Copyright Act of 1976. "Fair Use" legally eliminates the need to obtain
permission or pay royalties for the use of previously copyrighted materials
if the purposes of display include "criticism, comment, news reporting,
teaching, scholarship, and research." Section 107 establishes four criteria
for determining whether the use of a work in any particular case qualifies
as a "fair use". A work used does not necessarily have to satisfy all four
criteria to qualify as an instance of "fair use". Rather, "fair use" is
determined by the overall extent to which the cited work does or does not
substantially satisfy the criteria in their totality. If you wish to use
copyrighted material for purposes of your own that go beyond 'fair use,' you
must obtain permission from the copyright owner. For more information go to:
