Folks in Oswego and Oneida counties are getting a flier in the mail, outlining the claim. Assemblyman David Townsend's office sent the flyer from Albany last week making the connection. This week it's just making it into his constituents' mailboxes. One side of the flier says Indians should pay their fair share in taxes, and then it lists facts. It says an Indian reservation retailer was convicted on charges linking to him to an underground cigarette sting. That's true. There was a case involving the Seneca Indians back in 2003. The flier says congress issued a report linking illegal cigarette sales to international terrorism. That's also true. The report was issued back in April. Mark Emery, spokesman for the Oneida Indian Nation, said the facts aren't really connected to Oneida Indian Nation and it's irresponsible to relate 9/11 to the Oneida Nation. On the other side of the flier, there's a faint, blurry image of Turning Stone Casino, and again it mentions that congressional report making the connection between cigarette smugglers and terrorists. Assemblyman Townsend's was not in his Oneida County office Monday to answer questions about the flier and didn't return our phone calls. With the casino in Oneida County, the county executive says putting the flier in the mail doesn't make relations between government and sovereign nations any better. Anthony Picente said, "My role here is to try to keep a county together, and any enterprise we do business with here, and that chooses to do business here in Oneida County." The flier landing in mailboxes isn't helping the executive much, and the man sending the fliers isn't explaining much either. Copyright 2008 Newport Television LLC All rights reserved. "Fair Use" legally eliminates the need to obtain permission or pay royalties for the use of previously copyrighted materials if the purposes of display include "criticism, comment, news reporting, teaching, scholarship, and research." Section 107 establishes four criteria for determining whether the use of a work in any particular case qualifies as a "fair use". A work used does not necessarily have to satisfy all four criteria to qualify as an instance of "fair use". Rather, "fair use" is determined by the overall extent to which the cited work does or does not substantially satisfy the criteria in their totality.
