<http://www.worldnetdaily.com/news/article.asp?ARTICLE_ID=48868> Ramadan
Abdur Abdullah, is from Binghamton NY

In a sudden reversal, the Fresno County District Attorney's Office announced
Wednesday that it no longer will
<http://www.fresnobee.com/263/story/859362.html> pursue the death penalty
against Ramadan Abdullah, the 27-year-old schizophrenic man accused of
killing sheriff's deputy Erik Telen in 2001.

For almost six years, prosecutors insisted that Abdullah deserved to die for
his crime. But at a hastily arranged hearing Wednesday morning in Fresno
County Superior Court, prosecutors and defense attorneys told Judge Ralph
Nunez that they had reached a deal: Abdullah will drop his plea of not
guilty by reason of insanity, and prosecutors no longer will seek the death
penalty.

.html> MOA, made up of primarily African-Americans, are a cult-like offshoot
sect of Sufi Muslims who follow Sheikh Mubarak Ali Gilani of Pakistan. The
organization serves as a religious front for a radical militant group known
as Jamaat ul-Fuqra (JuF), a secretive network also headed by Gilani. For all
practical purposes, the groups are one and the same, though members'
knowledge of and/or involvement in illicit activity varies and terrorist
attacks, such as killing law enforcement officers.

Abdullah also agreed to waive his right to a jury trial and instead will
allow Nunez to decide his fate. The judge will review the evidence in the
case and announce his judgment next Wednesday, bringing to an end what had
become the longest-running court case in Fresno County in recent memory.

If Judge Nunez finds Abdullah guilty of first-degree murder with a special
circumstance, such as killing a peace officer in the line of duty, Abdullah
likely would be sentenced to life in prison without the possibility of
parole.
Why is the Fresno DA Liz Egan cutting a deal for cop killer "Mooselum"
Ramadan Abdur Abdullah ? Is it becuase Abdullah is a "Mooselum" ? Kill a
cop, you get the death penalty, no deals even if you are a "Mooselum".

District Attorney Elizabeth Egan issued a news release Wednesday announcing
the agreement. "The decision to seek life in prison without the possibility
of parole was made after careful consideration of the facts and consultation
with the family of Deputy Telen and the Fresno Sheriff's Department," Egan
said in the statement.

Former District Attorney Ed Hunt, who in December 2002 made the original
decision to pursue the death penalty against Abdullah, said he wasn't sure
why the District Attorney's Office altered course. "If something has changed
from the time I made that decision until today, I'm not aware of it," he
said. "They're going to have a bench trial and not seek death because they
believe he's questionably insane? Because he's not insane? Because he is
insane? I mean, I don't understand.

"I've always had a philosophy that if you kill a cop, you face the death
penalty."
After numerous delays, Abdullah's case went to trial in late March this
year. After a month of listening to testimony, jurors deliberated for a week
but were hopelessly deadlocked.

But on Tuesday, Nunez scheduled a hearing for Wednesday morning, a clerk
said. At the hearing, prosecutors and defense attorneys made their agreement
official. It appears that Egan had been considering dropping the death
penalty against Abdullah for some time before Monday. Mims said Egan had
consulted with her on the matter over the last few weeks.

In July 2001, Abdullah ran away from his family in Binghamton New York to
join an Islamic camp in the Tulare County foothills, the "
<http://www.worldnetdaily.com/news/article.asp?ARTICLE_ID=48868> Muslims of
the Americas". A month later, he ran off and broke into an unoccupied home
near Dunlap in rural Fresno County. When Telen, 26, and his partner entered
the house to investigate, Abdullah shot and killed Telen, from ambush,

At Abdullah's trial, defense attorneys acknowledged that Abdullah killed
Telen, but they said he was delusional at the time and so therefore should
be found guilty of second-degree murder. Prosecutor Dennis Peterson said
there was no evidence Abdullah was delusional.

Hobson, on a warrant for smuggling firearms between South Carolina and New
York... Detectives from the Fresno County sheriff's department searched the
Baladullah trailer of another resident, Ramadan Abdullah (from Binghamton
NY), who was charged with killing a deputy who had caught him breaking into
a home outside the community, possibly to steal guns. Detectives reported
seeing a small landing strip and firing range on the Baladullah property. In
Ramadan Abdullah's trailer, they found a book by Sheikh Mubarik Ali Jilani,
Sgt. Toby Rien said. The State Department says Jilani, a Pakistani cleric,
founded Al-Fuqra more than 20 years ago.

Baladullah (Fresno CA), detectives also observed near the front gate a sign

organization. The sign has since been removed. ATF agents say they have
looked into Baladullah (Fresno CA) as part of their investigation into
Al-Fuqra (Muslims of the Americas) activities at a similar remote settlement
in Virginia, where a man was convicted last month on federal firearms
violations. "They are all connected," said Bart McEntire, resident agent in
charge of the ATF in Virginia. "And I'm aware that there is this faction

If it were a fundamentalist Christian group organizing the event, dozens of

for friends of a cop killer. Up until at least 2005 he was an active
journalist and community organizer. He kept a blog and ran a website called
Modoc Press, part of "the global archipelago of dissent". He was an editor
for the New York University inter disciplinary journal Anamesa and
participated in something known as the narcosphere. His politics seem to
have been - to put it mildly - progressive. In fact, for a time he held the
position of " <http://www.cityofbinghamton.com/mayor.asp> Binghamton's
Progressive Advocate". He appeared in the Radicalendar and many Indymedia
newsletters and event listings. He helped organize antiwar marches back in
2002 and 2003, and took part in a local initiative to impeach President
Bush.He was especially active on behalf of the St. Patrick's Four: On
Monday, March 17, St. Patrick's Day [2003], four of us from the Ithaca
Catholic Worker Community - Peter De Mott, who served in both the Marines
and the Army including a year in Vietnam as a Marine, Clare and Teresa Grady
and Daniel Burns - went to the Army-Marine Recruiting Center in an act of
nonviolent civil resistance to war making.

We read the following statement and poured blood around the entrance to the
center, including on the flag, to call attention to the horror of war. The
protesters were arrested for their disruption of activities at the
recruiting center, prosecuted in federal court, and eventually convicted.
And <http://www.cityofbinghamton.com/mayor.asp> Tarik Abdelazim was with

most telling quote from <http://www.cityofbinghamton.com/mayor.asp> Mr.
Abdelazim's writings can be found in this letter to the editor of The New
York Times Magazine: The Terrorist As AuteurPublished: November 28,
2004....In the context of filmed beheadings, [Michael] Ignatieff concludes
that we still have the choice to decline our enemy's invitation deeper into
the darkening vortex of anything goes. More likely - and sadly - we are
already there. Whether by firebombing in aerial raids or mutilation by
knives, the death of innocent civilians should disgust us equally.

Consider this: Is it the filmed act itself that constitutes a more repugnant
form of barbarism, or is it that such war imagery dared to puncture our
mission of liberation? What's more, if we could compress all those killings
we cleanly record as "collateral damage" into a single picture of carnage, I
would bet Ignatieff would have a hard time determining which image reached
deeper into his moral void.

it any wonder, then, that <http://www.cityofbinghamton.com/faq.asp#265> Mr.

Abdullah won't face death, DA's office decides

In a sudden reversal, the Fresno County District Attorney's Office announced
Wednesday that it no longer will pursue the death penalty against Ramadan
Abdullah, the 27-year-old schizophrenic man accused of killing sheriff's
deputy Erik Telen in 2001.

For almost six years, prosecutors insisted that Abdullah deserved to die for
his crime. But at a hastily arranged hearing Wednesday morning in Fresno
County Superior Court, prosecutors and defense attorneys told Judge Ralph
Nunez that they had reached a deal: Abdullah will drop his plea of not
guilty by reason of insanity, and prosecutors no longer will seek the death
penalty.

Abdullah also agreed to waive his right to a jury trial and instead will
allow Nunez to decide his fate. The judge will review the evidence in the
case and announce his judgment next Wednesday, bringing to an end what had
become the longest-running court case in Fresno County in recent memory.

If Nunez finds Abdullah guilty of first-degree murder with a special
circumstance, such as killing a peace officer in the line of duty, Abdullah
likely would be sentenced to life in prison without the possibility of
parole.

District Attorney Elizabeth Egan issued a news release Wednesday announcing
the agreement.

"The decision to seek life in prison without the possibility of parole was
made after careful consideration of the facts and consultation with the
family of Deputy Telen and the Fresno Sheriff's Department," Egan said in
the statement.

Assistant District Attorney Jon Skiles said Egan would not comment further
until after Nunez reaches his judgment next week.

Sheriff Margaret Mims said she told Egan she would support the decision not
to pursue the death penalty as long as Telen's family members also approved
of that decision. Mims said she spoke with Telen's mother, Sharon Telen, and
his wife, Shelley Telen, who both said they did not object.

"Considering everything involved in this particular trial, I'm OK with
giving him life without the possibility of parole," Mims said.

Sharon Telen said she did not want to comment until after the judge's
decision next week.

Former District Attorney Ed Hunt, who in December 2002 made the original
decision to pursue the death penalty against Abdullah, said he wasn't sure
why the District Attorney's Office altered course.

"If something has changed from the time I made that decision until today,
I'm not aware of it," he said. "They're going to have a bench trial and not
seek death because they believe he's questionably insane? Because he's not
insane? Because he is insane? I mean, I don't understand.

"I've always had a philosophy that if you kill a cop, you face the death
penalty."

After numerous delays, Abdullah's case went to trial in late March this
year. After a month of listening to testimony, jurors deliberated for a week
but were hopelessly deadlocked.

Nunez declared a mistrial. Egan immediately announced her office would retry
the case "at the earliest date available" and continue to seek the death
penalty.

As recently as Monday, there was no sign of prosecutors budging on that
commitment. A hearing was held then to update Nunez on the status of the
case. Both prosecutors and defense attorneys said they were planning on
moving forward with a second trial in mid-October. They scheduled their next
hearing for Sept. 23.

But on Tuesday, Nunez scheduled a hearing for Wednesday morning, a clerk
said. At the hearing, prosecutors and defense attorneys made their agreement
official.

It appears that Egan had been considering dropping the death penalty against
Abdullah for some time before Monday. Mims said Egan had consulted with her
on the matter over the last few weeks.

In July 2001, Abdullah ran away from his family in New York to join an
Islamic camp in the Tulare County foothills. A month later, he ran off and
broke into an unoccupied home near Dunlap in rural Fresno County. When
Telen, 26, and his partner entered the house to investigate, Abdullah shot
and killed Telen.

At Abdullah's trial, defense attorneys acknowledged that Abdullah killed
Telen, but they said he was delusional at the time and so therefore should
be found guilty of second-degree murder. Prosecutor Dennis Peterson said
there was no evidence Abdullah was delusional.

Defense attorney Pete Jones said Wednesday he is pleased Abdullah no longer
faces the death penalty: "I think it's the right thing to do in this case
without a doubt."

No one from Abdullah's family could be reached for comment.

The principle of "Fair Use" was established as law by Section 107 of The
Copyright Act of 1976. "Fair Use" legally eliminates the need to obtain
permission or pay royalties for the use of previously copyrighted materials
if the purposes of display include "criticism, comment, news reporting,
teaching, scholarship, and research." Section 107 establishes four criteria
for determining whether the use of a work in any particular case qualifies
as a "fair use". A work used does not necessarily have to satisfy all four
criteria to qualify as an instance of "fair use". Rather, "fair use" is
determined by the overall extent to which the cited work does or does not
substantially satisfy the criteria in their totality. If you wish to use
