For almost six years, prosecutors insisted that Abdullah deserved to die for his crime. But at a hastily arranged hearing Wednesday morning in Fresno County Superior Court, prosecutors and defense attorneys told Judge Ralph Nunez that they had reached a deal: Abdullah will drop his plea of not guilty by reason of insanity, and prosecutors no longer will seek the death penalty. Abdullah also agreed to waive his right to a jury trial and instead will allow Nunez to decide his fate. The judge will review the evidence in the case and announce his judgment next Wednesday, bringing to an end what had become the longest-running court case in Fresno County in recent memory. If Nunez finds Abdullah guilty of first-degree murder with a special circumstance, such as killing a peace officer in the line of duty, Abdullah likely would be sentenced to life in prison without the possibility of parole. District Attorney Elizabeth Egan issued a news release Wednesday announcing the agreement. "The decision to seek life in prison without the possibility of parole was made after careful consideration of the facts and consultation with the family of Deputy Telen and the Fresno Sheriff's Department," Egan said in the statement. Assistant District Attorney Jon Skiles said Egan would not comment further until after Nunez reaches his judgment next week. Sheriff Margaret Mims said she told Egan she would support the decision not to pursue the death penalty as long as Telen's family members also approved of that decision. Mims said she spoke with Telen's mother, Sharon Telen, and his wife, Shelley Telen, who both said they did not object. "Considering everything involved in this particular trial, I'm OK with giving him life without the possibility of parole," Mims said. Sharon Telen said she did not want to comment until after the judge's decision next week. Former District Attorney Ed Hunt, who in December 2002 made the original decision to pursue the death penalty against Abdullah, said he wasn't sure why the District Attorney's Office altered course. "If something has changed from the time I made that decision until today, I'm not aware of it," he said. "They're going to have a bench trial and not seek death because they believe he's questionably insane? Because he's not insane? Because he is insane? I mean, I don't understand. "I've always had a philosophy that if you kill a cop, you face the death penalty." After numerous delays, Abdullah's case went to trial in late March this year. After a month of listening to testimony, jurors deliberated for a week but were hopelessly deadlocked. Nunez declared a mistrial. Egan immediately announced her office would retry the case "at the earliest date available" and continue to seek the death penalty. As recently as Monday, there was no sign of prosecutors budging on that commitment. A hearing was held then to update Nunez on the status of the case. Both prosecutors and defense attorneys said they were planning on moving forward with a second trial in mid-October. They scheduled their next hearing for Sept. 23. But on Tuesday, Nunez scheduled a hearing for Wednesday morning, a clerk said. At the hearing, prosecutors and defense attorneys made their agreement official. It appears that Egan had been considering dropping the death penalty against Abdullah for some time before Monday. Mims said Egan had consulted with her on the matter over the last few weeks. In July 2001, Abdullah ran away from his family in New York to join an Islamic camp in the Tulare County foothills. A month later, he ran off and broke into an unoccupied home near Dunlap in rural Fresno County. When Telen, 26, and his partner entered the house to investigate, Abdullah shot and killed Telen. At Abdullah's trial, defense attorneys acknowledged that Abdullah killed Telen, but they said he was delusional at the time and so therefore should be found guilty of second-degree murder. Prosecutor Dennis Peterson said there was no evidence Abdullah was delusional. Defense attorney Pete Jones said Wednesday he is pleased Abdullah no longer faces the death penalty: "I think it's the right thing to do in this case without a doubt."
